The terms we work under: quoting, booking, payment, warranty and what happens if something goes wrong.

These terms apply to the services Funkesound ("we", "us", "our") provides and to your use of this website. By booking work with us, you agree to them. If anything here does not suit your situation, talk to us before the job starts. We would rather agree something in writing than leave it unclear.
Funkesound is a sole trader based in Melbourne, Victoria, servicing Melbourne and the Mornington Peninsula.
Onsite quotes are free and carry no obligation. We quote after seeing the site, because the honest answer to "what will this cost?" usually depends on the wall, the roof, the cable run or the reception, and guessing over the phone helps nobody.
A quote covers the work described in it. If we get on site and find something the quote could not have anticipated: asbestos, unexpected wall construction, existing wiring that is unsafe, structural issues. We will stop, explain what we have found, and give you a revised price before doing any further work. We will not do additional chargeable work without your say-so.
Unless stated otherwise, a quote is valid for 30 days.
When we book a time, we turn up. In return we ask that someone aged 18 or over is present, that we have safe access to the work areas, and that the area around the install is reasonably clear.
If we cannot access the site at the booked time, or the site is not safe to work in, we may need to reschedule and may charge a call-out fee for the wasted visit. If you need to change or cancel a booking, please give us as much notice as you can.
You need to tell us, before work starts, about anything we could not reasonably know, including:
If you are not the owner of the property, you confirm you have the owner's permission for the work.
Where we supply equipment, it comes with the manufacturer's warranty, and we will pass on the details. Where you supply your own equipment, we will install it with care, but we cannot warrant equipment we did not supply and cannot be responsible for faults in it, its suitability, or its compatibility with your other gear.
Where a bracket or mount is involved, we select and install hardware rated for your screen and wall type. We will not install a customer-supplied bracket we consider unsafe for the job, and we will tell you why.
Payment is due on completion of the work unless we have agreed different terms with you in writing. For larger jobs we may ask for a deposit before ordering equipment.
Where equipment is supplied by us, title in that equipment stays with us until it has been paid for in full. Risk in the equipment passes to you on installation.
We warrant our workmanship. If something we installed fails because of how we installed it, contact us and we will come back and put it right at no charge.
That warranty does not cover:
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to cancel a service contract and to a refund for the unused portion, or to compensation for its reduced value, if we fail to meet a consumer guarantee and that failure is major. You are also entitled to be compensated for any other reasonably foreseeable loss or damage resulting from such a failure. If the failure is not major, you are entitled to have the problem rectified in a reasonable time, and if this is not done, to cancel the contract and obtain a refund for the unused portion.
Subject to section 7, and to the extent permitted by law, our liability for any claim connected with the work is limited to resupplying the service or paying the cost of having it resupplied.
Again subject to section 7, we are not liable for indirect or consequential loss (for example lost income, missed events, or the cost of alternative entertainment) arising from a delay, a fault, or an interruption to your system.
Drilling into walls carries an inherent risk of contacting a service that was not visible or disclosed. We take reasonable care, including checking the substrate before drilling, but we cannot be responsible for damage caused by concealed services we were not told about and could not reasonably detect.
